Jonathan Roch

Jonathan assists clients with the creation, protection, management, commercialization, licensing and enforcement of their intellectual property rights including patents, trademarks, copyright, industrial designs and trade secrets. Jonathan also represents clients in domain name disputes.

Jonathan has experience in all aspects of litigation and mediation involving intellectual property, and has appeared in proceedings before the Federal Court of Canada, the Federal Court of Appeal, the Ontario Superior Court of Justice and the Ontario Court of Appeal.  His experience and successes as an entrepreneur in a sports and technology SME have provided him with first-hand perspective of the intellectual property issues and concerns when starting and running a company.

He has extensive experience in drafting and prosecuting patent applications worldwide in a broad range of technologies including biochemistry, medical devices, environmental sciences and general mechanical inventions. Jonathan also has experience in drafting and negotiating intellectual property agreements, including assignment, partnership, agency, service, publishing, manufacturing, design, sales, supply, distribution, consulting, research, development, marketing, employment, independent contractor, non-disclosure, confidentiality and licensing agreements.

Wine has been both a passion and a hobby for many years for Jonathan. He is the firm’s resident wine expert providing a broad range of legal services to the beer, wine and spirits industries, including brand creation and protection, marketing, advertising and labeling laws and regulations, trademarks, certification marks, geographic indications, trade dress, distinguishing guise and export and import compliance.

Jonathan has been a guest lecturer at the University of Ottawa on exceptions to exclusive rights conferred by patents, the Patented Medicines Price Review Board (PMPRB) and Canada’s Access to Medicines Regime as part of a larger course on intellectual property law as it relates to biotechnology and pharmaceuticals. Jonathan is an Adjunct Professor in the Department of Bachelor of Applied Technology (Biotechnology) at La Cité Collégiale in Ottawa.

Jonathan is a Registered Canadian Patent and Trade-mark Agent and practices in both French and English.
